Terms of Use

1. Acceptance of these terms

By creating an account or using Peak Lotus Yoga, you agree to these Terms of Use, to our Privacy Policy and to our Health and Safety Disclaimer. If you do not agree with them, please do not use the app.

2. Who may use the app

You must be at least 13 years old to use Peak Lotus Yoga, and at least 16 years old where your local law requires it. If you are under 18, you may use the app only with the involvement of a parent or guardian, who agrees to these terms on your behalf.

3. Your account

• •Give us accurate information when you sign up and keep it up to date.
• •Keep your password confidential. You are responsible for activity that happens under your account.
• •One account is for one person. Do not share your login or your membership with anyone else.
• •Tell us straight away if you think someone else has accessed your account.

4. Health and safety

The poses, programs, breathing sessions, articles and other content in Peak Lotus Yoga are for general education only. They are not medical advice and are not a substitute for professional medical advice, diagnosis or treatment.

Consult a qualified healthcare professional before starting this or any exercise program, and never force a pose or movement. Stop immediately if you feel pain, dizziness, shortness of breath or any other unusual symptom. You practice at your own risk. Our Health and Safety Disclaimer forms part of these terms.

5. Peak Lotus Membership, billing and renewal

Peak Lotus Membership is a paid subscription that unlocks the complete asana library, the full mudra library, every article in the Learn library, pranayama sessions, guided programs, curated collections, the program builder, quizzes and progress tracking. A starter set of foundation poses and the starter breath practices stay free without a membership.

• •Peak Lotus Membership is $4.99 per month, or $39.99 per year, or the equivalent price shown at checkout in your currency.
• •Payment is charged to your chosen payment method when you confirm the purchase.
• •Your subscription renews automatically for the same period, at the price then in effect, until you cancel it.
• •Cancel at least 24 hours before the end of the current period to avoid being charged for the next one. You can cancel at any time and keep access until the end of the period you have already paid for.
• •If you subscribed through the Apple App Store, manage or cancel your subscription in your Apple ID settings, and Apple's billing and refund rules apply.
• •We may change the price or the content included in a membership. We will give you notice before a price change applies to you.

6. Refunds

Membership payments are generally non-refundable, except where the law or the store you purchased through requires otherwise. If you bought your subscription through the Apple App Store, refund requests are handled by Apple.

7. Content you create

Programs, sequences and notes you create stay yours. You give us permission to store them and show them back to you, and to other members only if you choose to share a program publicly. You are responsible for what you create and share.

8. Acceptable use

Please use the app as it is meant to be used. You agree not to:

• •Copy, scrape, redistribute or resell the app's content, or use it to teach paid classes without our written permission.
• •Reverse engineer, decompile or attempt to extract the source code of the app.
• •Share your account, or resell or transfer access to your membership.
• •Upload or share anything unlawful, harmful, misleading or that infringes someone else's rights.
• •Interfere with the app, or attempt to access data belonging to other members.
• •Use automated tools to access or harvest content from the app.

9. Our content and intellectual property

The poses and their instructions, articles, images and audio, the app design and the Peak Lotus Yoga and Heal with Mindfulness names and marks belong to us or are licensed to us. We grant you a personal, non-transferable licence to use the app and its content for your own practice. Saving or sharing a screenshot for personal use is fine; republishing content anywhere else is not.

10. Availability and changes to the app

We may add, change or remove features and content as the app develops. We work to keep the app available, but we cannot promise it will always be uninterrupted or error-free, and we may need to take it offline for maintenance.

11. Suspension and termination

You may stop using the app and ask us to delete your account at any time. We may suspend or end your access if you break these terms or misuse the service. Sections that by their nature should survive termination, such as intellectual property, disclaimers, liability and refunds, continue to apply.

12. Disclaimers

The app and its content are provided as they are. To the fullest extent the law allows, we make no warranties that the content is complete, accurate or suitable for your particular circumstances, and we do not promise any particular result from your practice. Nothing here replaces a qualified teacher or medical professional.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental or consequential losses, or for loss of data, profits or goodwill. Our total liability for any claim relating to the app is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

14. Governing law

These terms are governed by the laws of the jurisdiction in which Heal with Mindfulness is established, and disputes will be handled by the competent courts there, without affecting any rights you have under the consumer law of your own country.

15. Changes to these terms

We may update these terms as the app changes. We will update the date at the top of this page, and for significant changes we will tell you in the app. Continuing to use Peak Lotus Yoga after a change means you accept the updated terms.
